By accessing or using the WeDrive application and website ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and WeDrive.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be a person barred from receiving services under applicable laws
  • Possess a valid driver's license and vehicle insurance (if offering rides as a driver)

3. Account Registration

To access certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Services Description

WeDrive is a carpooling platform that connects drivers with available seats to riders traveling in the same direction. We act as an intermediary to facilitate ride-sharing arrangements between users. WeDrive does not provide transportation services directly and is not a transportation carrier.

5. User Responsibilities

5.1 For All Users

  • Behave respectfully and courteously toward other users
  • Comply with all applicable laws and regulations
  • Not use the Services for any illegal or unauthorized purpose
  • Provide accurate information about your identity and trip details
  • Not engage in discriminatory behavior
  • Not use the platform for commercial transportation services

5.2 For Drivers

  • Maintain a valid driver's license and vehicle insurance
  • Ensure your vehicle is in safe and roadworthy condition
  • Follow all traffic laws and regulations
  • Not drive under the influence of alcohol or drugs
  • Complete the identity verification process
  • Provide the ride as described in the listing

5.3 For Riders

  • Arrive at the agreed pickup location on time
  • Pay the agreed fare through the platform
  • Not bring prohibited items or substances
  • Treat the driver's vehicle with respect
  • Wear seatbelts during the ride

6. Payments and Fees

  • Ride fares are calculated based on distance, route, and cost-sharing among passengers
  • WeDrive may charge a service fee for facilitating the ride
  • All payments must be made through the platform's payment system
  • Drivers receive their share of the fare after deducting applicable fees
  • Refunds are handled according to our Cancellation Policy

7. Cancellation Policy

Users may cancel a booked ride subject to our Cancellation Policy. Cancellation fees may apply depending on the timing and circumstances of the cancellation.

8. Safety and Insurance

While WeDrive implements safety measures including identity verification, ratings, and real-time tracking, users acknowledge that:

  • WeDrive does not guarantee the safety of any ride
  • Users ride at their own risk
  • Drivers are responsible for maintaining adequate vehicle insurance
  • Users should exercise personal judgment and caution when sharing rides

9. Intellectual Property

The Services, including all content, features, and functionality, are owned by WeDrive and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.

10. Limitation of Liability

To the maximum extent permitted by applicable law, WeDrive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Services.

WeDrive's total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid to WeDrive in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless WeDrive, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Services or violation of these Terms.

12. Termination

WeDrive reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the app or by email. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WeDrive operates, without regard to its conflict of law provisions.
